Registration RequirementsParticipants must be at least 18 years of age. Registration, which is free and requires a valid driver’s license, involves obtaining a bidder number and agreeing to provide accurate, current information to the Auctioneer.

Conditions of BiddingDo not place bids if you are unable to adhere to these terms, or if you cannot fulfill payment and collection obligations within the specified timeframe.

Buyer’s PremiumA buyer’s premium of 18% will be applied to all purchases, in addition to any applicable sales tax

Inspection and Preview GuidelinesInspections are scheduled for the day prior to the auction. This opportunity allows for a visual examination of items, with the option to test them under the direct oversight of our auction staff. We strongly encourage thorough inspection before placing any bids, as all decisions to bid should be informed and considered final. Items are offered on an “as is” basis, with no warranty implied or expressed.Please note that inspections are purely visual, and any testing must be conducted within the parameters set by our staff. It’s crucial for buyers to conduct their own evaluations to inform their bidding decisions, relying solely on their judgment.All items up for auction are sold “As Is” and “Where Is,” without any form of warranty or guarantee regarding their condition, authenticity, or any potential defects. The auction company is not liable for inaccuracies in item descriptions, authenticity, or any defects found. No compensation will be provided for any discrepancies or issues post-sale. Item descriptions and representations are intended solely for identification and do not serve as warranties.

Bidding Process and ResponsibilitiesWhen you place a bid, you are entering into a legally binding contract with the item’s seller, committing to purchase the item at your bid price if you are the winning bidder. This commitment cannot be withdrawn once a bid is placed. Failing to fulfill the payment for a won item is considered illegal in many jurisdictions and can lead to prosecution. Non-payment will also lead to a permanent ban from participating in future auctions, at the discretion of the auctioneer.Online bidders are solely responsible for the security of their bidding credentials, including their bidding number and password. It’s your duty to ensure that all bids made with your credentials are secure and intentional. Should you suspect any compromise to the security of your bidder information, it is imperative to inform the Auction Company immediately.For those registering on behalf of a business entity, you assert that your registration binds the entity legally, making both you and the entity jointly liable for the settlement of any purchases.By participating in bidding, you agree to indemnify and hold harmless the owners, sellers, and the auctioneer, along with their employees, officers, and affiliates, from any claims, damages, or expenses arising from your use of the auction site. This includes any injuries or damage incurred during the inspection, removal, or transport of purchased items, and any legal disputes or violations of the site’s terms of use.

Seller Property Withdrawal and Bid Rejection PolicyWhile we strive to maintain the availability of all items or lots once they have been listed for sale, there are instances where it may become necessary to withdraw them.The owners or sellers of properties being auctioned reserve the exclusive right to reject any or all bids at their complete discretion. This policy ensures the integrity and fairness of the auction process, allowing for adjustments as needed to address unforeseen circ*mstances.

Payment InstructionsAll payments must be completed in full using cash, credit/debit card, direct deposit, ACH, cashier’s check, or money order made out to Vision Equipment and Auction Company, Inc. For transactions over $10,000, a wire transfer to Vision Equipment and Auction Company, Inc. is required. Payments should be promptly made following the auction’s conclusion, unless specific alternate arrangements are outlined in the “Auction Details” for that event.Please be aware that any invoices left unpaid, and items not collected by the specified deadline will incur a non-negotiable non-payment fee. This fee is the greater of 50% of the invoice total or $100. This non-refundable fee will be charged to the credit or debit card provided by the buyer. Non-compliance with payment obligations will lead to a permanent exclusion from future auctions and may trigger the pursuit of legal actions to recover the debt.

State Sales Tax PolicyAll purchases are subject to the addition of state and local sales taxes, as mandated by law, to the buyer’s invoice. To avoid these taxes, buyers must submit a valid Tax-Exempt Form to the auctioneer before making payment. This ensures compliance with tax regulations while accommodating tax-exempt purchasers.

Item Removal GuidelinesBuyers are required to remove their purchased items within 5 days following the auction or within the designated removal period. The process of removal is solely the buyer’s responsibility, including all costs, liabilities, and risks involved. An appointment for removal is not necessary. However, to collect your items, you must present a valid government-issued photo ID along with a printed copy of your paid invoice. Items will not be released until the auctioneer has received full payment.Vision Equipment and Auction Company, Inc. provides limited assistance with the loading of items. For large or heavy equipment, a forklift is available to aid in loading. It is the buyer’s responsibility to manage the remainder of the loading process, including securing the load. Buyers should ensure they arrive with the appropriate vehicle, labor, and equipment (such as straps, ropes, and boxes) necessary for safely transporting their purchases.

Freight and Shipping ResponsibilitiesThe responsibility for arranging and covering the cost of freight falls entirely on the buyer. To facilitate shipping, a Bill of Lading must be provided, ensuring merchandise is shipped on the agreed-upon date. Please note that our services only include an estimate of the pallets’ weight and dimensions, without any guarantee.We offer a palletization service, which includes bubble wrapping and strapping of items onto a pallet. This service incurs a packaging fee, payable at the same time as your invoice. It’s important to understand that we do not disassemble equipment; it will be loaded onto the pallet as is. By agreeing to these terms, the buyer acknowledges that Vision Equipment and Auction Company, Inc. holds no liability for any damage that occurs to the equipment once it has left the auction premises.

Online Bidding DisclaimerThe Auctioneer will not be liable for any disruptions, errors, or omissions in the service, nor do we guarantee continuous, uninterrupted, or error-free operation of the website. Participants acknowledge the inherent risks of electronic auctions, which depend on technology that may fail unexpectedly. The Auctioneer reserves the right to nullify any transactions, halt bidding, and re-auction items impacted by technical issues at our discretion. The Auctioneer’s decisions are final and binding.Participation in the auction constitutes agreement to these legally binding terms and conditions. Violation of these terms may prompt Vision Equipment and its representatives to seek legal action, including reporting to law enforcement as necessary. The Auctioneer has the authority to exclude any individual from participation in the auction for reasons deemed appropriate, including disabling an online bidder’s account at any discretion, specified or otherwise.
